The Constitution of Aldart

Under the authority of the Crown Jewel, and with the advice and consent of Queen Airis, we the Citizens of the Kingdom of Aldart hereby establish a new government for ourselves and our descendants, so that all may enjoy the promise of liberty and equality.

Article I

This Nation shall be known as the Republic of Aldart. The seat of government of the Republic of Aldart shall be the city of Lishdurk, the home of the Royal Palace.

Districts of the Republic of Aldart are independent regions, which may have their own government and Constitutions at their discretion. Each Citizen of the Republic shall be entitled to all the privileges and immunities of each District when they are residing therein.

This Constitution, laws made in accordance thereof, and all treaties made under authority of the Crown Jewel shall be the Supreme Law of the Land, and all people and judges in every District shall be bound thereby, anything in the constitution or the laws of any District to the contrary notwithstanding.

Each Delegate to the Nunzakon, Advisor to the Crown, Overseer of the Bankadi, members of legislatures of all Districts, all lesser judges, and all representatives of the Republic must state on oath or affirmation that they will act in the best interest of the Republic and its Citizens, and will support and defend this Constitution.

Article II

The Crown is the bearer of the Crown Jewel, and is styled “King” or “Queen” at the Crown’s preference. The Crown is the absolute ruler of the Republic of Aldart.

The Crown shall have the exclusive power to overrule the Nunzakon, declare war, negotiate treaties, and grant reprieves and pardons for offences against the Republic or any District except in the case of impeachment. The Crown shall be the Commander in Chief of the military of the Republic and shall commision all officers of the Republic. The Crown shall take care to properly execute the laws of the Republic.

Each District of the Republic of Aldart shall send one Advisor to the Crown to the seat of government, where the Advisors will meet as the Board of Advisors. This Board shall serve to advise the Crown on issues of law and issues of concern to their respective Districts. No person shall be an Advisor unless they have reached the age of fourty, been a resident of the District that has appointed them for twelve years, and be learned in the law.

If the Board of Advisors unanimously votes against the Crown’s action, the Crown shall not take that particular action. These Advisors serve at the pleasure of their District and the Crown. If an Advisor is recalled by their District, the remaining Advisors may petition the Crown to permit the Advisor to remain.

The first Crown was Aldart, and the descendants of Aldart, in order of age, form the line of succession to the Crown. If it is determined that the Crown is not fit to rule, by means of impeachment, the Crown passes to the next individual in the line of succession.

Any law created by the Crown shall be subject to the same restrictions as a law created by the Nunzakon.

The Crown shall, from time to time, meet with the Citizens of the Republic of Aldart, and shall answer truthfully any questions that they may ask, and shall grant favors that do not act against the will of the Citizens or the Republic of Aldart.

Article III

The legislative power of the Republic of Aldart shall be vested in the Nunzakon, consisting of twenty Delegates from each District. Each District shall be divided into ten contingous regions of equal size, and each region shall appoint a number of Delagates to the Nunzakon in proportion to its population. Legislation shall carry legal force if approved by a simple majority of Delegates, and is approved by the Crown. If the Crown refuses to accept legislation, the Nunzakon may, by four-fifths vote, overrule the Crown, at which point the law is enacted.

No person shall be a Delegate unless they exceed the age of twenty-five, been a resident of the Republic of Aldart for eight years, and reside in the District at the time of their election.

Every five years the number of Citizens in each District shall be enumerated and regions in each district shall be entitled to appoint Delegates in accordance with this new enumeration at the time of the next election.

Delagates shall be appointed to the Nunzakon by popular vote, and Delagates serve for six year terms before they shall be subject to another ordinary election. However, if the Citizens represented by the Delegate decide, by a three-fifths majority of votes, that the Delegate is not representing their interests, is unfit to be a Delegate, or for any other reason does not wish for that Delegate to represent them, that Delegate shall be removed from the Nunzakon and a special election shall be held by the region for a replacement. If a Delegate is replaced in this capacity, the replacement shall serve for a full term starting from the date of their election.

The Nunzakon shall have the sole power of impeachment, in which the Nunzakon may expell Delegates, Members of the Board of Advisors, Overseers of the Bankadi, and the Crown themself. A call for impeachment shall include a list of high crimes of which the individual is accused, and shall only carry legal force if it is approved by three-fifths of the Delegates to the Nunzakon.

The Nunzakon shall have the power to lay and collect taxes, duties, imposts, and excises, to pay the debts and provide for the common defense and general welfare of the Republic, to borrow money on credit of the Republic, to regulate commerce with foreign nations and between Districts, to coin money and regulate the value thereof, to raise an army, and to to make all laws which may be necessary and proper for the benefit of the Republic of Aldart and the execution of the powers herein vested.

The Nunzakon shall not pass any law which deprives any person of life, liberty, privacy, or property without due process of law, and no person shall be deprived equal protection of the laws within its jurisdiction, nor shall any District.

Neither the Nunzankon nor any District shall pass any law favoring one religion over another, nor no religion over religion, nor religion over non-religion, nor shall they pass any law restricting the freedom of speech, nor the freedom of the press, nor the freedom to petition the Government for redress of grievences, nor the freedom of movement between districts, nor shall they pass any law removing the right of Citizens to be secure in their belongings, nor shall private land be taken without just compensation.

Article IV

The judicial power of the Republic of Aldart shall be vested in the Bankadi and other lesser courts. The Bankadi shall have appealate jurisdiction over all cases or controversies originating in the Republic of Aldart, and shall have original jurisdiction over all cases or controversies involving the Republic of Aldart or one of its Districts. The Bankadi shall consist of six Overseers and one Chief Overseer, who shall interpret the law of the Republic of Aldart and this Constitution. The Nunzakon, the Board of Advisors, the governments of the various Districts, and the Crown are bound by the decisions of the Bankadi, however the Bankadi may overrule one of its own precedents.

New Overseers of the Bankadi shall be proposed by the Crown. If a proposed Overseer recieves the support of three-fifths of the Board of Advisors and a majority of the Nunzakon, the proposed Overseer shall join the Bankadi.

If a call for impeachment carries legal force, the call shall be sent to the Chief Overseer of the Bankadi, who shall determine the validity of the charges.
If the charges are valid, the Chief Overseer shall preside over the trial of the subject of the call for impeachment. The trial shall be conducted in the presence of the Crown, the Nunzakon, and the Board of Advisors, and a person shall be impeached if a four-fifths majority of the Nunzakon, the Board of Advisors, and the Bankadi concur.

Each District shall have one appellate court within its borders that shall interpret matters of law regarding to that District. These Lesser Courts shall have appellate jurisdiction over all cases or controversies originating in the District.
Each Lesser Court may, when requested, provide advice to its respective District on whether or not an action is in violation of this Constitution, law passed by the Nunzakon, or the District’s constitution. Judges of the Lesser Courts shall be appointed by the Bankadi by majority vote.

In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial by an impartial jury of the District where the crime was committed, to be informed of the nature and cause of the accusation, to be confronted with the witnesses against them, to have process for obtaining witnesses in their favor, and to have assistance of counsel for their defense.

No person shall be required to provide testimony against themself, nor shall they be tried more than once for the same crime, nor be held to answer for an infamous crime unless on a indictment of a grand jury, nor be compelled to reveal the contents of their own mind. Excessive bail shall not be required, nor excessive fines imposed, nor cruel or unusual punishments inflicted. The privilege of the writ of habeus corpus shall not be suspended unless when in cases of rebellion or invasion the public safety may require it.

Article V

Amendments to this Constitution shall be proposed by the Nunzakon, or shall be proposed by the Citizens of the various Districts. If an Amendment is passed by the Nunzakon, and is unanimously approved by the Board, it shall be sent to the individual Districts. If three-quarters of the Districts approve of the Amendment by a two-thirds majority of the popular vote, it shall become part of this Constitution.

If an Amendment is proposed by the Districts by means of a two-thirds popular vote in each District, it shall be sent to the Nunzakon and the Board of Advisors. If a majority of the Nunzakon and three-fifths of the Board of Advisors approve of the Amendment, it shall become part of this Constitution. If an Amendment is supported by all districts by a popular vote of nine-tenths, it shall become part of this Constitution regardless of any other actions.

Article VI

No District shall enter into any treaty, alliance, or confederation, coin money, pass any bill of attainder or ex post facto law, or pass law impairing the obligation of contracts. No District shall enter into any agreement or compact with a foreign Power or engage in war unless actually invaded or in such imminent Danger as will not admit delay.

No District may deny a lawful Citizen the right to vote in any election.

This Constitution shall come into effect when ratified by three-fourths of the Districts in existence at the time of writing.

Articles of Amendment

Amendment I

We the People of the Republic of Aldart, acting in accord with the will of the Nunzakon, the Board of Advisors, and three-quarters of the Districts hereby amend the Constitution of the Republic of Aldart as follows:

Article III of this Constitution shall be amended in the following manner: the legal force clause shall be amended to read:

- Legislation shall carry legal force if approved by a simple majority of Delegates, including one Delegate from each District, and is approved by the Crown.

Amendment II

We the People of the Republic of Aldart, acting in accord with the will of nine-tenths of the Citizens of this Republic hereby amend the Constitution of the Republic of Aldart as follows:

Article III of this Constitution shall be amended in the following manner: the following clause shall be appended:

- No bills of attainder nor ex post facto laws shall be passed by the Nunzakon.

Amendment III

We the People of the Republic of Aldart, acting in accord with the will of nine-tenths of the Citizens of this Republic hereby amend the Constitution of the Republic of Aldart as follows:

Article V of this Constitution shall be amended in the following manner: the following paragraph shall be appended:

- The Crown may propose Amendments to this Constitution. If a majority of the Districts approve of the Amendment by a majority of the popular vote, it shall become part of this Constitution.

Amendment IV

We the People of the Republic of Aldart, acting in accord with the will of nine-tenths of the Citizens of this Republic hereby amend the Constitution of the Republic of Aldart as follows:

Article I of this Constitution shall be amended in the following manner: the following paragraph shall be inserted between paragraphs two and three:

- New Districts shall be added to the Republic of Aldart by treaty ratified by the Nunzakon, at which point the new District must ratify this Constitution and shall be subject thereto. All new Districts of the Republic of Aldart shall be on an equal footing with the original Districts in all respects whatever.

Amendment V

We the People of the Republic of Aldart, acting in accord with the will of two thirds of the Citizens of the Republic, the Nunzakon, and three-fifths of the Board of Advisors, hereby amend the Constitution of the Republic of Aldart as follows:

Article III of this Constitution shall be amended in the following manner: the following paragraph shall be inserted between paragraphs five and six:

- The Board of Advisors shall have the power to introduce legislation to the Nunzakon. Each Advisor’s vote shall count for ten votes, and they shall represent their home district for purposes of quorum.

Article IV of this Constitution shall be amended in the following manner: the Appointment of Lesser Judges clause shall be amended to read:

- Judges of the Lesser Courts shall be appointed by the Board of Advisors by majority vote with the advice and consent of the Bankadi.

Amendment VII

We the People of the Republic of Aldart, acting in accord with the will of the Nunzakon, the Board of Advisors, and three-quarters of the Districts hereby amend the Constitution of the Republic of Aldart as follows:

Article III of this Constitution shall be amended in the following manner: the following clause shall be inserted between paragraphs one and two:

- If three-fifths of the Board of Advisors vote against a certain law before it is enacted, that law does not carry legal force.

Amendment VIII

We the People of the Republic of Aldart, acting in accord with the will of nine-tenths of the Citizens of this Republic hereby amend the Constitution of the Republic of Aldart as follows:

Article II of this Constitution shall be amended in the following manner: the following clause shall be inserted between paragraphs four and five:

- If there is no remaining descendent of Aldart, the position of the Crown shall be dissolved and the powers granted herein shall be granted to the Board.

Amendment IX

We the People of the Republic of Aldart, acting in accord with the will of the Nunzakon, the Board of Advisors, and three-quarters of the Districts hereby amend the Constitution of the Republic of Aldart as follows:

Article IV of this Constitution shall be amended in the following manner: the following clause shall be inserted between paragraphs three and four:

- For this procedure, if the Chief Overseer is the Subject of the Call for Impeachment, the other Overseers shall assume the Responsibilities and Duties of the Chief Overseer. All decisions shall be made by majority vote of the remaining Overseers.

Amendment X

We the People of the Republic of Aldart, acting in accord with the will of nine-tenths of the Citizens of this Republic hereby amend the Constitution of the Republic of Aldart as follows:

Article II of this Constitution shall be amended in the following manner: the following paragraph shall be appended:

- This Royal Address shall occur twice per year. All Citizens who desire to address the Crown shall declare their intention, and the Crown Jewel shall, at random, select Citizens to recieve a notice that they have been selected. The Crown shall be bound by the obligations above when they are in the presence of a notice.

We the People of the Republic of Aldart, acting in accord with the will of the Nunzakon, the Board of Advisors, and three-quarters of the Districts hereby amend the Constitution of the Republic of Aldart as follows:

Article IV of this Constitution shall be amended in the following manner: the Appointment of Lesser Judges clause shall be amended to read:

- Judges of the Lesser Courts shall be appointed by the Board of Advisors by majority vote.

We the People of the Republic of Aldart, acting in accord with the will of nine-tenths of the Citizens of this Republic hereby amend the Constitution of the Republic of Aldart as follows:

Article I of this Constitution shall be amended in the following manner: the Oath or Affirmation clause shall be amended to read:

- Each Delegate to the Nunzakon, Advisor to the Crown, Overseer of the Bankadi, members of legislatures of all Districts, all lesser judges, and all representatives of the Republic must state on oath or affirmation that they will act in the best interest of the Republic and its Citizens, and will support and defend this Constitution; but the Crown may, from time to time, waive this requirement at their discretion if they deem it necessary.

Amendment XIII

We the People of the Republic of Aldart, acting in accord with the will of two thirds of the Citizens of the Republic, the Nunzakon, and three-fifths of the Board of Advisors, hereby amend the Constitution of the Republic of Aldart as follows:

Article II of this Constitution shall be amended in the following manner: the following clause shall be appended:

- The Crown may, at their discretion, designate a Citizen of the Republic as an acting Crown, enjoying all the priveleges and responsiblities of the Crown proper; such an appointment must obtain the unanimous approval of the Board and the concurrence of four-fifths of the Nunzakon.

Amendment XIV

We the People of the Republic of Aldart, acting in accord with the will of nine-tenths of the Citizens of this Republic hereby amend the Constitution of the Republic of Aldart as follows:

Article III of this Constitution shall be amended in the following manner: the Replacement of Delegate clause shall be amended to read:

- If a Delegate is replaced in this capacity, the replacement shall serve for the remainder of the original Delegate’s term, and shall then be subject to an election as usual.

Amendment XV

We the People of the Republic of Aldart, at the request of King Amar and in accord with the will of a majority of the Citizens of the Republic of Aldart hereby amend the Constitution of the Republic of Aldart as follows:

The eighth and twelfth Articles of Amendment to this Constitution shall be repealed in their entirety.

Article II of this Constitution shall be amended in the following manner: the following paragraph shall be inserted between paragraphs four and five:

- If there is no remaining descendent of Aldart, the position of the Crown shall be dissolved. The powers herein vested in the Crown shall be vested in a Prime Minister, elected by popular vote by the Citizens of the Districts. The Prime Minister shall exceed the age of fourty and have been a Citizen of the Republic of Aldart for thirty years. The Nunzakon and the Board of Advisors shall, by four-fifths vote each, judge the qualifications of any candidate for Prime Minister and shall have the power to invalidate all votes for an unqualified candidate. All references to the Crown herein shall refer to the Prime Minister. The Prime Minister shall be styled “Your Excellency”.

Article I of this Constitution shall be amended in the following manner: the Oath or Affirmation clause shall be amended to read:

- The Prime Minister, each Delegate to the Nunzakon, Advisor to the Crown, Overseer of the Bankadi, members of legislatures of all Districts, all lesser judges, and all representatives of the Republic must state on oath or affirmation that they will act in the best interest of the Republic and its Citizens, and will support and defend this Constitution; but the Crown may, from time to time, waive this requirement at their discretion if they deem it necessary for any representative of the Republic except the Prime Minister.

Amendment XVI

We the People of the Republic of Aldart, acting in accord with the will of the Nunzakon, the Board of Advisors, and three-quarters of the Districts hereby amend the Constitution of the Republic of Aldart as follows:

The third Article of Amendment to this Constitution shall be repealed in its entirety.

Article V of this Constitution shall be amended in the following manner: the following paragraph shall be appended:

- The Crown may propose Amendments to this Constitution. If a majority of the Districts approve of the Amendment by a majority of the popular vote, and the Board of Advisors unanimously concurs, it shall become part of this Constitution.

Amendment XVII

We the People of the Republic of Aldart, acting in accord with the will of the Nunzakon, the Board of Advisors, and three-quarters of the Districts hereby amend the Constitution of the Republic of Aldart as follows:

Article VI of this Constitution shall be amended in the following manner: the following clause shall be inserted between paragraphs one and two:

- Any person born within the Republic of Aldart or born to Citizens of the Republic of Aldart shall be a Citizen themself, and Citizenship cannot be revoked except by the consent of the Citizen or a unanimous vote by the Nunzakon and the approval of the Crown.

Amendment XVIII

We the People of the Republic of Aldart, acting in accord with the will of the Nunzakon, the Board of Advisors, and three-quarters of the Districts hereby amend the Constitution of the Republic of Aldart as follows:

Article II of this Constitution shall be amended in the following manner: the following clause shall be appended:

- If the Crown has not reached the age of eighteen, the Nunzakon shall elect amoung themselves a leader who shall, with the advice and consent of the Board of Advisors, act as Prime Minister until the Crown has reached the age of eighteen, at which point the position of Prime Minister is dissolved; the Prime Minister shall in this case be subject to an election by the Delegates every two years, and shall be removed from the position upon a three-fifths vote of the Citizens of the Republic.

Amendment XIX

We the People of the Republic of Aldart, acting in accord with the will of the Nunzakon, the Board of Advisors, and three-quarters of the Districts hereby amend the Constitution of the Republic of Aldart as follows:

Article III of this Constitution shall be amended in the following manner: the takings clause shall be amended to read:

- … nor shall private land be taken for public use without just compensation, nor shall private land be taken for the use of another private Citizen.
